No Law Compelling Release Of CCTV Footage To PCA

There is currently no legal requirement mandating individuals to hand over private CCTV footage to the Police Complaints Authority (PCA).

This was confirmed by the Leader of Government Business in the Senate and Minister in the Office of the Prime Minister, Darrell Allahar, on Tuesday.

« The PCA formally requests the cooperation of property owners or other lawful custodians of the footage and seeks their consent to obtain and review the material. Currently, under the Police Complaints Authority Act, there is no legal compulsion requiring private property owners to provide CCTV footage to the Authority where such footage is sought. As a result, the PCA relies on the voluntary cooperation of citizens. »

Minister Allahar noted that the PCA treats all evidence received in the strictest confidence and utilises such material solely for the purpose of advancing its statutory investigations.

He was responding to a question on behalf of the Minister of Justice, Devesh Maharaj.
