CEPEP Wins Appeal In Test Case Brought By Contractor Eastman Enterprise Limited
The Court of Appeal has upheld a ruling in favour of CEPEP in a case brought by contractor Eastman Enterprises Limited.
The Court dismissed Eastman Enterprises’ challenge, ruling that the CEPEP contractors breached their contract by ignoring the dispute resolution process. The court criticised the contractor for bypassing these steps and reaffirmed that parties must honour their agreements before approaching the courts.
The unanimous judgement was delivered by Justice of Appeal Peter Rajkumar.
The CEPEP Company was represented by a team of attorneys from Freedom Law Chambers led by Anand Ramlogan SC while Larry Lalla SC, and Kareem Marcelle appeared for Eastman Enterprises.
