The Court of Appeal has delivered a landmark ruling on a constitutional challenge arising from the Government’s 2020 COVID-19 border closure policy.
The judgment, in the case of Lorick and Pantin v the Attorney General, centred on the State’s administration of the travel exemption system for nationals stranded abroad.
The Court unanimously ruled against the State, finding that the Minister of National Security’s failure to publicly disclose the criteria for granting exemptions was unconstitutional.
Former Attorney General Anand Ramlogan SC has described this as a historic and landmark judgment. He joins us via telephone to tell us more.
